MELBOURNE, April 28 AAP - Victorian Premier Ted Baillieu says the federal government
is putting up unnecessary barriers to securing Commonwealth flood levy funding for flood-ravaged
communities.
Mr Baillieu has accused the federal government of trying to avoid delivering $500 million
earmarked for Victoria's 94 flood-ravaged communities after Queensland received $2 billion.
Victoria is refusing to sign up to the National Partnership Agreement, saying it wants
to avoid a repeat of Labor's bungled household insulation scheme.
"I think (the Commonwealth is) needlessly imposing bureaucracy where they don't need
to," Mr Baillieu said on Thursday.
"If we can encourage them to spend money more wisely we would be foolish not to do that."
Regional Australia Minister Simon Crean says the federal government is not withholding the funds.
"We made the commitment to support Victoria as we did Queensland in the flood recovery
effort," Mr Crean told reporters in Brisbane.
"We will honour that commitment. What we need is a framework to deliver it through.
"We've got that framework with Queensland, we simply need it with Victoria."
He said the federal government was waiting for the Victorian government to sign the agreement.
"If we're putting large amounts of taxpayers' dollars in, including the flood levy,
people want to know if it's going to the right purpose and we need a framework that ensures
that happens," Mr Crean said.

FED:PM Gillard stands by mining tax plan
Prime Minister Julia Gillard says she won't be changing the minerals resources rent
tax which she negotiated with big resource companies last year.
The Australian Greens have released a report today showing the MRRT - which replaced
the resource super profits tax proposed by former prime minister Kevin Rudd - would reap
up to 115 billion dollars less revenue over nine years than Mr Rudd's plan.
Ms GILLARD says the legislation will go through parliament this year and the tax would
start in July next year.
She says the huge profit announced yesterday by BHP Billiton shows there's no reason
for the tax to be changed, especially when the high Aussie dollar is putting pressure
on parts of the economy.

The coalition has rejected Labor frontbencher CRAIG EMERSON'S claims that legislation
will be required to resume offshore processing at Nauru.
Dr EMERSON says if the coalition was in government .. it wouldn't be able to count
on its own numbers to pass the legislation .. as promised during the election campaign.
He says Liberals JUDI MOYLAN and RUSSELL BROADBENT would cross the floor on the issue
.. and reject any push to reinstate temporary protection visas.
But Liberal frontbencher SOPHIE MIRABELLA has told Sky News that the Labor party didn't
change the legislation enabling offshore processing .. which means it's still in place.

Fed: Who owns what tax is a taxing question

CANBERRA, April 23 AAP - Possession is nine tenths of the law, so the saying goes,
but not when it comes to tax it would seem.
We often hear the phrase "spending taxpayers' money" when it comes to the federal government
paying for a new initiative, or worse, "wasting taxpayers' money" on things like the infamous
insulation fiasco.
It's an odd concept, because for many of us on Pay As You Go (PAYG), we earn the money
that's taxed, yes, but we hardly own the tax.
It's a bit of a stretch from that fleeting eye over a payslip from net income ("is
that all") to income tax ("that damn taxman") to call it possession.
But then there is the view of the state premiers.
In this week's long-winded negotiations over the government's hospitals reform proposal,
the sticking point for many was - and still is for West Australian Premier Colin Barnett
- they didn't want to give up "their GST".
Their GST?
Surely they mean the consumers' GST, because we actually have the money in our possession
that gets slugged 10 per cent when we spend it on goods and services.
Semantics aside, the premiers and chief ministers no doubt are concerned what bag of
tricks the long-awaited Henry Tax Review will present them, aside from this massive tinkering
with the GST.
After all, one aim of the review is to whittle down the existing 125 federal, state
and local taxes across the nation, particularly when just 10 of them rake in 90 per cent
of total revenue.
While there were concessions on both sides in bringing the hospitals agreement together
- apart from Mr Barnett - Treasurer Wayne Swan didn't cave in and present the premiers
with the tax review as they originally demanded.
Nor has he given in to opposition treasury spokesman Joe Hockey's persistent demands
to see the review.
Mr Hockey pointed out on Wednesday that the treasurer has now had the review for 120
days since its author, Treasury secretary Ken Henry, handed it over.
"That's 120 days that Australians have been kept in the dark about the Rudd government's
secret tax plans," Mr Hockey said in a statement.
Make that 121 and counting.
"The Rudd government has had more than enough time to consider the taxpayer-funded review."
Well, according to Prime Minister Kevin Rudd just a week ago, his budget team were
still working through the review.
It must be a mammoth document, and much, much larger than the 1000 pages claimed by
those said to have seen it.
Mr Swan has repeatedly said it will be released with the government's recommendations
before the release of his 2010/11 budget on May 11.
As such, speculation in Canberra's press gallery when the review might be finally released
remains rife.
By default, someone will guess the right date as the days tick down.
Obviously, it won't be in the next couple of days as the treasurer is in the United
States for the G20 finance ministers meeting, ending with an address to the Anzac memorial
dawn service at the Korean War Memorial in Washington.
Nor would you think it would clash with the release of the key March quarter consumer
price index next Wednesday, the Reserve Bank of Australia's board meeting on May 4 or
the central bank's quarterly statement on monetary policy on May 7.
Which leaves April 27, 29 and 30, and May 3, 5, 6 and 10.
And of course, there is the morning of the May 11 budget.
Let's hope not.
It could also be done over one of the two remaining weekends should the treasurer want
to avoid an immediate reaction from the the financial markets.
But while the review could include a change in mining royalties to a new national tax
on mining companies, this has been heavily speculated in the media for some time, suggesting
it may already have been discounted by the market.
However, such a change could be a reason why Mr Barnett is holding out on parting with
30 per cent of WA's GST revenue for the the national hospitals reform.
Other recommendations are expected to include how savings are taxed, and a simpler
way of doing personal tax returns, to name just two ideas being floated, but likely to
be the tip of the iceberg.
The theory goes on the latter that an 'an optional tax return' would see taxpayers
sent a one-page statement from the ATO that would set out income to the best of their
knowledge, tax cuts based on occupation and any monies due back or owing.
The individual could then assess whether they agree with this assessment, or reject
it and lodge their own tax return.
If this proves the case, let's hope the tax office has ironed out its IT glitches that
saw 140,000 Australians initially miss out on receiving a cheque with their tax refunds
earlier this month.
That was definitely their money.

Vic: Man set alight by his ex and her new love: court
MELBOURNE, Dec 9 AAP - A Melbourne man was allegedly set alight by his ex-lover and
a neighbour she had taken up with, a court has heard.
Kim Emery, 36, and John Rossi, 52, are facing a committal hearing in the Melbourne
Magistrates Court over the arson attack on Peter D'Amore that left him with severe head
and upper body burns.
The court heard Emery and Mr D'Amore were in a relationship when she began seeing Rossi,
who lived across the road only 100 metres from their home in Melbourne's north.
Emery moved in with Rossi and began feuding with Mr D'Amore about her belongings.
On the day of the attack on April 16, Mr D'Amore told the court he threw a large plank
of wood at Rossi's feet and the pair swore at each other.
The pair began throwing punches.
Police allege Rossi then asked Emery to pass something to him, believed to be an igniting
instrument.
Rossi then allegedly set D'Amore alight, causing him to be engulfed in flames.
"The next thing I remember I was on fire," Mr D'Amore said in his statement to police.
"My hair, my back and my arm was on fire. I knew that he wanted to kill me; I thought
I was going to die."
Mr D'Amore said he put his head under a tap before being taken to The Alfred hospital
with severe burns.
Emery and Rossi are each charged with attempted murder, reckless conduct endangering
death and intentionally cause serious injury.
The committal hearing is continuing.

VIC: Drive-by shooting rattles car, but none injured
A McDonald's restaurant in Melbourne's west has been locked down after a car was hit
by shots in a drive-by shooting.
Multiple shots were fired from a car in Altona North last night as it drove past the
fast-food chain's parking lot where another car was parked.
Two people were in the parked car but no one was injured.
Store manager RAPHAEL DELACRUZ says police arrived quickly after the victims reported
the shooting to police.

ECONOMY QLD (BRISBANE)
The Queensland Government's planning to form rapid response teams to fight escalating
unemployment.
Premier ANNA BLIGH says the teams .. made up of employers .. unions and government
agencies .. will work together to combat problems expected during 2009 as a result of
the slowing economy.
The state government formed similar teams to try to find alternative work for 540 workers
laid off from central Queensland coal mines in recent weeks.
It also brought forward 25 million dollars in funds to boost employment in areas affected
by the mining downturn caused by the global economic crisis.
TITO (MELBOURNE)
A man arrested over a fatal screwdriver stabbing at a Melbourne party has had his charge
upgraded to murder.
STEPHEN TITO is alleged to have stabbed 19-year-old AFRAM KODI to death on Friday night.
Mr KODI suffered critical injuries .. described by ambulance as horrendous .. and died
in hospital on Saturday afternoon.
TITO was charged with attempted murder over the attack .. a charge which remains in
place .. but he also now has been charged with murder .. and was remanded in custody till
his next court appearance in May.
HANEEF (BRISBANE)
Queensland Premier ANNA BLIGH has called on the federal government to formally apologise
to Dr MOHAMED HANEEF.
The Indian-born doctor was wrongfully charged and detained in relation to failed terrorist
attacks in Glasgow and London last year.
Ms BLIGH has told reporters it is the federal government's duty to say sorry to an
innocent man .. who has been through a traumatic experience.
A spokeswoman for Federal Attorney-General ROBERT MCCLELLAND says the relevant agencies
have to shoulder the blame for mistakes identified in the HANEEF inquiry .. and the government
will implement the changes recommended by the inquiry.
SPEEDBOAT (MELBOURNE)
A 16 year old Melbourne boy has been charged with manslaughter following the death
of an 18 year old woman on Lake Eildon.
The boy was allegedly driving a speedboat which ran into a tree sticking out of the
lake .. north-east of Melbourne .. about 1.30 on Sunday morning (AEDT).
The impact threw the young woman out of the boat .. and her body was recovered a short
time later.
The teenager's been bailed to appear at a children's court in the near future.

Telstra users are expected to welcome the new year by sending up to one thousand text
messages a second .. with more than 76 million predicted to be sent as part of New Year
celebrations.
The number would be a record for Australia's largest telco.

A group of Japanese atomic bomb survivors is in Australia as part of a three-month
global sea voyage to oppose nuclear weapons.
They've presented a letter to the federal government .. praising Australia for its
decision to establish the International Commission on Nuclear Non-Proliferation and Disarmament.
The letter urges Canberra to lead other countries in the abolition of nuclear weapons.

The New South Wales government's challenged a report which has found companies operating
in the state suffer the highest taxes in Australia.

A chronic smoker who has to use a ventilator to breathe is seriously ill in hospital
after blowing himself up by having a cigarette while using his oxygen tank.
The explosion happened as the 75-year-old man lit up in his home while attached to
an oxygen tank that had plastic tubes running to his nose because of lung disease caused
by his smoking habit.

Qld: Bruce Highway closed after semi-trailers collide
BRISBANE, Aug 20 AAP - Two semi-trailers have collided in central Queensland, closing
the Bruce Highway near Bundaberg.
The semi-trailers appear to have side-swiped each other, causing one truck to roll
and catch fire, about eight kilometres south of Gin Gin just after 3.30am (AEST) today,
police said.
The highway will remain closed for some hours while heavy equipment is bought in to
move the wreckage with traffic between Childers and Gin Gin diverted through Bundaberg.
One driver has been taken to Bundaberg Hospital with leg injuries and the other escaped unharmed.

WA: Baby snatching prompts hospital security upgrade
There's to be a major security upgrade at Perth's main maternity hospital following
the kidnapping of a newborn baby last November.
More than 640 thousand dollars will be spent on closed circuit TV .. more security
guards and other measures at King Edward Memorial Hospital.
WA Health Minister JIM MCGINTY says it's important to have a high level of security
without locking the hospital down.
The measures .. to be introduced by December .. follow a security review after a three-day-old
baby girl was snatched from the hospital last November.
A 31-year-old woman was later charged with child stealing.
The review also recommended electronic baby tagging and the photographing of newborns
.. but Mr MCGINTY says we don't have the technology for effective tagging .. and babies'
faces change so quickly it's impractical to snap them.

Vic: Police speak to crash victims' friends
MELBOURNE, Dec 10 AAP - Victoria Police are speaking to a group of friends who were
in a car driving alongside the vehicle involved in last night's fiery crash that killed
four people on a Melbourne freeway.
Major Collisions Investigation Unit head Inspector Richard Watkins said the young people
were helping them with inquiries.
"They will probably continue to help us in the future," Insp Watkins told Southern
Cross Broadcasting.
"They say they knew the driver and they had been with them earlier in the day.
"From there, the story's blurry and we need to make some more inquiries with them."
Insp Watkins said two 18-year-old males and two 17-year-old males were incinerated
in the crash, but no names would be released until probably tomorrow.
"Forensically it's difficult to do a normal identification, the coroner controls that
and it's a scientific process," he said.
He also acknowledged speculation the Holden Commodore in the crash had been in a drag
race at the time.
"We are not in a position to say that's the case," he said.
"We'd like witnesses to tell us if they saw any driver behaviour before the crash.
"We are not able to rule out drugs or alcohol."
Insp Watkins said the car was travelling on the West Gate Freeway in Altona North when
it appeared to have oversteered.
"It cut across the right lanes into the left-hand lane and hit a tree," he said.
He said too many young people died in car crashes and more education was needed, although
the road toll had been falling in recent years.

NSW: Foundation for skaters in memory of ferry crash victim
A foundation's been created in memory of a teenager killed in a fatal Sydney ferry
crash .. to help future ice skaters.
14-year-old MORGAN INNES was one of four people killed .. when a HarbourCat and a private
cruiser collided on Sydney Harbour last month.
Now her father ROBERT .. has launched the Morgan Innes Foundation .. to help ice skaters
who show talent .. and those from under-privileged backgrounds.
MORGAN was a competitive ice-skater who had won two Queensland championships.
Mr INNES says there'll be enormous pride in the future .. if a young Australian wins
a medal at the winter Olympics .. and their success can be traced back to the Foundation.
He says his main motivation in establishing it .. is to ensure his daughter's memory
lives on in the years to come.

SYDNEY, December 27 AAP - It's well past time to have mercy on David Hicks, says today's
editorial in the Australian Financial Review.
If Christmas is a time for reflection, says the Review, one of the things Howard government
ministers should reflect on during their break is whether they should change course and
extend some seasonal goodwill and mercy to Hicks.
The Adelaide man has been held at the US military base at Guantanamo Bay in Cuba since
December 2001.
The Financial Review says that whatever the actions of Hicks, who apparently was detained
with Taliban fighters in Afghanistan, he has already effectively served a lengthy sentence
without claims against him having been tested.
His access to legal advice is restricted; even a psychiatrist has been denied him and
the accusations are for crimes of association.
The Fin Review says our closest Western compatriot, the United Kingdom - itself more
directly committed to the battlefield in Iraq - believed the reasonable time for detention
expired two years ago and required its citizens be released to face justice within its
own legal system.
However, says the paper, the Australian government appears stubbornly acquiescent in
renewed US administration attempts to create a military commission to try detainees that
complies with its own constitution.
The Financial Review says it doesn't mean Hicks hasn't been foolish, dangerous or guilty
of acts that resulted in harm to others.
But our system of justice requires that evidence be brought forward in a public hearing
in a recognised court in which prosecution claims can be tested within a reasonable period
and a jury can convict or acquit.
Meanwhile, The Australian newspaper's main editorial asserts that NSW Labor is set
for victory by default in the March state election.
The paper says the latest Newspoll results on voting intentions provide a sobering
measure of the size of the task ahead of the Opposition in the run-up to the poll.
"For Labor Premier Morris Iemma the results must refresh his belief in Santa Clause
and pose the intriguing question: - just how bad must a government be to blow the benefits
of incumbency? the paper asks.
Against the template of recent elections in Queensland and Victoria, the Newspoll results
suggest the NSW Government can expect to cruise home to a comfortable victory in March,
says The Australian.
"Months of scandal and ministerial resignations, culminating in drugs and under-age
sex charges against Aboriginal services minister Milton Orkopoulos, have not been enough
to cut deeply into the Iemma Government's popularity," says The Australian.
"Nor has the poor comparative economic performance of NSW against the other states,
the Bob Carr legacy of neglected state infrastructure and rundown government services,
or the argument that state Labor is fatigued after 11 years in office."
The Australian says the poll results are a terrible indictment on the competence and
performance of the state Opposition.
Under the headline "Planning with a shoval, the Sydney Morning Herald's main editorial
says Sydney's suburbs are changing, as, indeed, they must.
But the way they are being changed leaves much to be desired.
The Herald says that according to the Metropolitan Strategy released a year ago, Sydney
will grow by 1.1 million people by 2031 and will need an extra 640,000 dwellings to house
them all.
Sydney councils are starting to feel the planning squeeze, says the paper, as the State
Government forces them to increase population densities over the next two-and-a-half decades.
"Fundamentally this is the right strategy - Sydney must become a denser city lest it
turn into a wasteful, car-dominated environmental disaster," says the Herald.
"But any increase in density must be planned intelligently, so a more highly concentrated
population does not reduce residents' standards of living.
"The present planning approach, particularly for transport, raises doubts about whether
this will be achieved."
A Sydney Daily Telegraph editorial comments on how interstate people moving to Sydney
are dumbfounded at the city's high cost of living.
Rent, insurance, rates and basically every aspect of life in Sydney are substantially
above levels in other state capitals.
And now migrants from overseas, attracted to Sydney as a first option for their new
lives in Australia, are also realising just how prohibitive is the cost of living.
This year, NSW attracted just a third of the nation's immigrants. A decade ago, that
figure was closer to half.
The Telegraph says it is impossible to ignore high - and rising - costs as an underlying
cause. According to an international study, sydney is now the 16th most expensive city
to live in - up from 25th a year earlier.
Brisbane's Courier Mail says the year is ending with a great deal of turmoil in the
world, while closer to home, Australia has faced challenges in East Timor, Papua New Guinea,
the Solomons and Fiji.
The paper says that along with our commitment to the war on terror, the demanding role
of regional policeman is stretching Australia's military ... and has prompted the Howard
Government to pledge further resources and manpower for the armed forces.
Australia's place in the broader region is good, says Courier.
"We boast sound relations with Indonesia in particular and South East Asia generally.
We are well placed to benefit from the emerging economies of India and China - and have
a key role to play balancing strategic and commercial interests in the latter, especially
as they affect relations with the US.
There is a regional and international effort to curb the nuclear ambitions in North
Korea; and, although the pre-Christmas six-nation talks in Beijing were wordy but insubstantial,
while there is contact there is a chance of progress.
With so many flashpoints around the globe, we can only hope for resolve, common sense
and, when needed, patience.
Meanwhile, Melbourne's Herald Sun says Shane Warne's 700th wicket during the 100th
MCG Test is yet another golden moment in the stadium's history.
"More than just a sporting venue, the G has become the heart and soul of Melbourne

of the willing's invasion in March 2003 to civil war in 2006."
It was an invasion built on lies of weapons of mass destruction and a false link between
September 11 and al-Qaeda, and the body count is mounting.
"In Australia, Prime Minister John Howard and Foreign Minister Alexander Downer have
stoutly defended the government's position to follow the US to Iraq and to remain there.
Yet a growing chorus of disapproval and censure to this position is making itself heard."
While a sudden withdrawal is not the answer to stabilising the country, greater emphasis
is needed on training Iraqis to quash the sectarian violence. Dialogue needs to be opened
with Iraq's neighbours such as Syria and Iran to find an approach to lasting peace.

Ballmer tells critics he's staying put at Microsoft; Passionate response to those pushing for new CEO; He calls on real-estate industry to make new NBA arena happen.(News)

For the first time, Steve Ballmer took a public swing at critics who say he should step down as Microsoft chief executive.
"You tell me if I lack energy, conviction or we're not driving all the change we need to drive," Ballmer shouted after a lunch attendee asked his reaction to an investor's call for his resignation.
Ballmer spoke at a civic-group luncheon Wednesday at the Westin Hotel in Seattle.
Investor David Einhorn, a hedge-fund manager who used to be one of the largest shareholders in the Redmond company, called in May for Ballmer's departure, according to several reports. He blamed Ballmer's presence for Microsoft's stagnant stock price over the past 10 years.
In his speech to the Seattle Rotary Club, Ballmer also talked about the difficulty of bringing an NBA franchise back to Seattle and the importance of state investment in transportation and education.
It also sounded like Ballmer pre-announced Microsoft's earnings for the 2011 fiscal year, which the company is scheduled to report July 21.
"There's a reason why we'll do almost $70 billion in revenue this year and we'll make over $20, whatever, $26, $27 billion in profits," Ballmer said.
Microsoft said after the speech that Ballmer had been referring to $26 billion to $27 billion of operating profit, not net income. Analysts were expecting an operating profit of $27.2 billion and for Microsoft to bring in $69.8 billion sales for fiscal 2011.
Another attendee asked about Ballmer's interest in buying an NBA team to play in Seattle. Ballmer led an investment group in 2008 to try to keep the Sonics in Seattle, but the team ended up moving to Oklahoma City and becoming the Thunder.
"The challenges there are real-estate challenges, honestly. KeyArena would not be able to have an NBA team in it that could be competitive," Ballmer said.
"The simple economics are if you don't have a nice enough building, you can't sell enough of the right kind of tickets at the right kind of prices. If you can't do that, you can't pay the players the right amount of money and you can't compete and you can't fill the seats."
He said it takes $300 million to $500 million to remodel or build a competitive arena, and that the money needs to come either from real-estate investment or from the city, county or state, which were not interested in contributing.
"I'm sure we'll someday wind up with that problem solved and with a basketball team back here in Seattle."
Ballmer tasked the real-estate industry to make it happen. "If you want to get on that problem, I'll offer to buy the first season ticket."
Ballmer called Seattle the most important technology hub after the Bay Area and said he hopes the state will invest in transportation and education to keep it competitive.
"After Silicon Valley, it's hard to cite any place in the world that is as vibrant a tech community as the Puget Sound," he said.
Ballmer said he looks forward to replacement of the Highway 520 bridge and said he wants to see the state focus on schools.
"We're all going to have to do our part to support and do what it takes to improve the K-12 education in the state," he said.
Microsoft recently gave $25 million to build a college-scholarship endowment for students in Washington. Microsoft chief counsel Brad Smith chaired a higher-education task force for Gov. Chris Gregoire that led to the endowment and to new legislation giving colleges the ability to set their own tuition.
On technology, Ballmer identified three areas of innovation to watch:
"No. 1, your computer will learn to recognize you, even more than it does today. It will see you. It will recognize your gestures, your voice, your fingers," he said.
Microsoft built Kinect, a camera that senses motion and sound, for the Xbox video-game console, and will bring it to Windows for use with computers.
Secondly, "My computer will actually learn to understand me," Ballmer said. He said that, if he told his computer today, "Get me ready for my trip to the Rotary," nothing would happen, but that tools such as Bing search are changing that.
Then he mentioned cloud computing, where software and data are stored at remote servers run by companies like Microsoft and Amazon.com. People access the software through computers, mobile phones and televisions.
"The cloud is essentially a buzzword that refers to using the Internet to connect you even more seamlessly to the people and information that's important to you," Ballmer said. "Those phenomena, in the large, will be the source of so many new companies ... that it will be a really exciting time over the next five, 10 years."
Ballmer said Windows remains very important to Microsoft. "If you cut me open and saw what was inside? Windows," he said. "It's just Windows, Windows, Windows."

It is expected that revenue from M-Commerce will increase tenfold from 2010 to 2014 in the USA, where in 2011 the number of mobile Internet users is predicted to reach more than 100 million. A similar trend is shaping up in Latin America, where according to predictions in 2015 more than 450 million people will use cell phones.
Smartphones support the positive trend in Europe In the EU5 (Great Britain, Germany, France, Spain, Italy) more than 90 million individuals are expected to use mobile Internet by 2015. In Germany an M-Commerce boom is predicted spurred by the growing popularity of smartphones. In 2010, more than 20 % of all smartphone owners used their device on a regular basis to search for product information. In Great Britain M-Commerce revenue is expected to double over the next three years.
However, only a small percentage of the British population has previously used cell phones for their purchases. As demonstrated in the Global Mobile and M-Commerce Trends 2011 report by yStats.com, 10 % of all consumers in France used M-Commerce in 2010, while one quarter of mobile Internet users made purchases using their cell phones in the first half of 2010. In Sweden 20 % of the population accessed the Internet with a mobile device.
Asian markets are leading the M-Commerce trend In Japan almost 10 % of all mobile Internet users visited shopping portals using a cell phone in December 2010. In China M-Commerce accounted for 6 % of mobile Internet revenue. Thailand was, - followed by Indonesia - the leading Asian country where most users intended to use M-Commerce. Australia is also expecting a strong increase in M-Commerce for 2011. In South Africa 40 % accessed the Internet via cell phones in 2010.

- In the US, M-Commerce sales are expected to increase tenfold between 2010 and 2014. Furthermore, the number of mobile Internet users is expected to reach more than 100 million in 2011, approximately one third of the total population.

Members of the print community may find themselves quoting Queen Elizabeth II when referring to 2009. It was, for the majority of the industry, the "annus horribilis"--the horrible year. Last year marked the peak of the worst recession most of us have ever seen. A great many printing company owners were forced to sell their businesses or simply close their doors.
As the most identifiable microcosm of the print universe, the franchise segment presents us with a snapshot of the troubles that have dogged the larger industry. It also offers a glimpse of the turning tide as financial recovery begins. The observations offered up by the franchise leaders provide insight into their varied strategies for leading their affiliates into a brighter future.
The only franchise that did not report this year was LAZERQUICK. As a general rule, when a system fails to report, we estimate its sales to be on a fairly even par with the latest reported figures we have from them. In this case, however, that method is not supported. We must presume that LAZERQUICK was dealing with the same economy that everyone else endured. Because of that, the system's sales figures have been adjusted downward. Information about shop locations and franchise fees were obtained from various reliable sources on the Internet, including the company's own website.
Cast of Characters
At the end of 2009, virtually every metric tracked in QP's Annual Franchise Review was down across the board. System-wide sales were down. Sales per shop dipped sharply. The number of franchise locations decreased--although, admittedly, that has been happening every year for about a decade now. The only category that seemed to be on the rise was the number of shops that left their franchise systems. Most struck out on their own as independents, some were consolidated, and a few went out of business completely.
As the curtain rose on the second decade of the millennium, there were seven U.S. based franchise systems with 2,795 shops worldwide. That is 138 fewer shops than the previous year; down by 4.7%. There were 2,153 shops in North America; a loss of 188 units, or 8.03% on the year.
Minuteman Press, with 942 locations, is still the largest system worldwide. Franchise Services, has a total of 634 locations. It is followed by ICED with 488, Allegra with 350, AlphaGraphics with 267, CPrint International with 95, and LAZERQUICK with 21 locations.
Of those companies, Allegra, CPrint, and LAZERQUICK are strictly North American concerns, meaning that all of their franchisees are in either the U.S. or Canada. Franchise Services has 498 franchisees in North America under the banners of Sir Speedy Printing and Marketing Services, PIP Printing and Marketing Services, and Signal Graphics. The majority of AlphaGraphics' locations--234 of them--are in North America. ICED, on the other hand, maintains only 148 of its locations in the U.S. and Canada under the names of Kwik Kopy Printing, Franklin's Printing, The Ink Well, and Kwik Kopy Business Centers.
If you are adding up the numbers on your own, you will need to subtract two U.S. locations from your total. Affinity franchise CPrint has two franchisees that are also members of other, primary franchises. Therefore, they have been backed out of the total so that they would not be counted twice. That is also the reason that the total number of shops will show a variance in some of the charts that accompany this article. The total numbers are correct.
While it was once quite common for franchisors to maintain locations that were corporately owned and operated, that practice began to fade about 12-15 years ago. LAZERQUICK and ICED are now the only systems that have corporate locations. ICED has a single such location. LAZERQUICK, however, owns 11 of the 21 locations that make up its system. It is also the only franchise that is still a strictly regional interest, with all locations operating on the West Coast.
Neither ICED nor LAZERQUICK opened any new locations in 2009. Minuteman opened 29 shops, AlphaGraphics opened 24, Allegra opened 15, CPrint added 11, and Franchise Services opened four shops. That's a total of 83 new locations.
Those openings were offset, in most cases, by franchisees leaving the systems for various reasons. Minuteman saw 55 shops leave. ICED bid goodbye to 41 stores. Franchise Services lost 35, and Allegra lost 31. AlphaGraphics and CPrint each dropped 16 locations, and LAZERQUICK closed one corporate location and lost one franchised shop. The total number of shops leaving franchise systems was 196. CPrint president Todd Nuckols points out that five of the 16 businesses reported as leaving that system were sold to new owners.
One of the ways that franchisors stay healthy is by reselling franchise locations to new owners when franchisees depart the system. The total number of shops resold in 2009 was 93. Minuteman is at the top of this category, as always, with 64 shops resold. AlphaGraphics and Franchise Services each resold 10 locations, Allegra resold eight, and ICED resold one.
Box Office
Overall, system-wide sales were down by 17.13% in 2009, with total sales from the franchise segment of the quick/small commercial printing industry being $1,666,453,846. Average system-wide sales came in at $238,269,549; a 20.6% shortfall from the previous year.
Franchise Services reported the highest system-wide sales with $460 million, an 18.17% drop from the previous year. Minuteman, with total sales of $400 million, was down by 13.98% on the year. AlphaGraphics fell by 16.54% to $241,893,547. The $233 million reported by Allegra reflected a 15% shortfall. ICED, with sales of $222,135,254, was down by 26.38%. CPrint reported the shallowest cut of 5.23% to garner total sales of $96,158,045. And LAZERQUICK's estimated $14.7 million system-wide sales add up to a 13.98% decline.
If there is a bright spot in this year's Franchise Review, it is that average sales per shop (SPS) was not down nearly as much as system-wide sales. The overall average SPS was $596,227, down by 14.9% on the year.
This year, CPrint is the SPS leader with average sales per shop of $1,012,089. It is also the only system to report an increase in SPS, even if it is only 0.74%. AlphaGraphics, which frequently holds the top spot in this category, saw SPS fall by 18.74% to $948,125. Franchise Services, with SPS of $730,000, slid by 15.75%. Allegra's average SPS fell 12.55% to $685,000. Minuteman's franchisees, on average, felt a pinch of 10%, with SPS of $500,000. ICED suffered the greatest SPS loss of 24.05%, with average sales of $486,218.
North American sales for the franchise systems only fared slightly better. Total sales of $1,357,828,486 were off by 17.07%. Allegra, CPrint, and LAZERQUICK have no locations outside the U.S. and Canada, so their system-wide figures are unchanged. Here are the North American sales results for the more global systems. Franchise Services, with total sales of $363 million, was down by 23.73%. Minuteman's 12.5% shortfall accompanied sales of $350 million. AlphaGraphics' sales totaled $205,843,753, with a 15.45% decrease from the previous year. And ICED posted a 23.92% decline, with North American sales of $96,559,688.
Average SPS for all North American franchisees was $630,668--considerably better than the worldwide average. However, that did not carry over to individual systems. For AlphaGraphics' franchisees on this continent, average SPS was $879,674. Franchise Services' average SPS was $728,915. Minuteman posted average SPS of $432,632. And ICED toted up average SPS of $410,892 on this side of the pond.
Pay the Piper
The benefits of belonging to a franchise system are many. They range in scope from pricing agreements with equipment vendors and training programs to assistance with financial planning and designing business plans. There is also the more intangible benefit of having a built in group of business associates who can be called upon for advice and feedback.
Of course, there is a price for gaining access to those advantages. In 2009, the price paid to join most systems went up. Not all franchisors raised the cost of entry or the total investment required, but most did. And, of course, there are royalties to be paid as well.
The initial investment required to become a franchisee held steady for Franchise Services ($150,000), Minuteman ($55,000), and LAZERQUICK ($25,000). ICED raised its entry price 2.03% to $74,000. CPrint's start-up cost jumped 20% to $5,000. And Allegra bumped up its ante by 40% to $150,000. Bucking the trend, AlphaGraphics lowered its start-up investment by 8.97% to $78,000.
The total investment required to be part of Franchise Services or CPrint was unchanged at $288,000 and $12,579, respectively. Please note that CPrint's investment costs are considerably lower than other franchises because it accepts only established printing companies, meaning that no major equipment purchases are required.
Allegra, AlphaGraphics, and ICED raised their total investment requirements. Allegra's 12.22% increase brought the maximum investment amount to $485,000. AlphaGraphics raised it's final cost by 2.21% to $424,000. And ICED's total investment jumped 17.1% to $252,680. LAZERQUICK dropped its total investment by 9.09% to $275,000. Minuteman decreased its total cost by a whopping 44% to $125,000.
Method Acting
Even for a comparatively disappointing year, more than $1.66 billion is not exactly chump change. It is even more impressive when you take into consideration that the franchise segment makes up less than 10% of the quick/small commercial printing industry.
So how did the franchises bring in that amount of cash? The lion's share came from color digital printing, which brought in 23.9% of sales. For those of you who are counting, that totals $398,282,469. The second largest block of work was multi-color offset, which at 17.8% of sales, brought in $296,644,805. Monochrome digital printing made up 12.6% of sales, or $209,973,185.
Ten percent of sales ($166,645,385) fell into the brokered/other category. Four-color offset and bindery/finishing services each brought in 8.3% of sales, or $138,315,669. Prepress work accounted for $103,320,138, or 6.2% of total sales.
Single-color offset work has been in a slow decline for a number of years. This year it fell to 4% of sales; off from 7.9% last year. Nonetheless, that is still worth $66,658,154. The numbers reported in this year's survey indicate that the work that has fallen out of this category has been shifted to the color digital and multi-color offset categories. That is a positive sign, considering how much more profitable color work is.
Wide-format printing and mailing services have been on the rise in recent years. Both categories increased their percentage of sales in 2009. Mailing services made up 5% of sales, or $83,322,692, up from 4.1%. Wide-format printing accounted for $64,991,700, or 3.9% of overall sales, up from 3.3%.
Curtain Call
The dismal economy of the past 18 months may be as good an argument as any for the value of franchise affiliation. Independent printing business owners may feel a tinge of envy for those who have the option of reaching out for help from a larger organization that has a vested interest in their success. The training and business services offered to franchisees probably saved some from failure and helped others minimize their losses during these tough times.
Comments from the franchise leaders indicate that they are positioning their systems to leverage new capabilities and customer demands to build a stronger future. It's no wonder that many who are new to the industry (and a few who have been around for a while) are opting to take advantage of the various conversion programs.
As the economy begins to improve, the franchisees who take advantage of the tools that are available to them will likely find themselves well equipped to take on the next opportunities the industry offers.
Yes, But What About ...?
Every year after the annual Franchise Review hits the streets, we get questions from readers asking why a particular print-related franchise has not been included. So, before that happens this year, here are the criteria and the reasons that some systems are not on the list.
First, those included in the Franchise Review must be actual quick and small commercial printers whose main products are printing and copying produced in-house. With the changes in technology, these printers now do more than simple ink or toner on paper, but that remains the mainstay of their business.
Thus, although the 625-franchise Proforma system has several million dollar franchisees, they are not included because they broker printing rather than producing it. Also not included is the UPS Store/Mailboxes, Etc. franchise system which, while actually producing printing, gets the majority of its business from packing and shipping. There are also about 18 franchise systems of varying sizes in the sign/wide-format segment that are not included. (They will be reviewed in the July issue of our sister publication, Wide-Format Imaging.)
One shipping/printing franchise operation which may someday be added to the list is PostNet, which is mounting a major effort to expand its digital quick and small commercial print offerings and capabilities.
Finally, we have the old FedEx Kinko's (now FedEx Office) operation, which is corporate owned, is not a franchise, and has never been included.

An Embassy Suites and a conference center are planned in Olathe. John Q. Hammons Hotels and Resorts is planning the 11-story hotel with atrium-style interior, sports bar, Internet cafe, gift shop, fitness center, and a pool. The conference center will be adjacent to the hotel situated at Kansas Highway 10 and Ridgeview Road. The company expects to break ground this fall with completion expected in the spring of 2010. The hotel will cost more than $75 million. Olathe will own the convention center. City officials say the community needs more space and capacity for its growing number of events.
Direct and digital marketing M&A deals poised to rocket.
Merger and acquisition (M&A) activity is set to soar in the interactive and direct marketing sectors more than any other marketing discipline, according to a new report, which predicts 2007 will be a boom year.
The M&A survey, carried out by WKS Results, points to an escalating growth in both sectors which were best represented with 33 and 29 per cent of responses compared to 20 per cent for sectors including advertising and database marketing.
The industry expects strongest growth in the digital sector, with specialist agencies the primary focus for M&A activity, followed closely by database and direct marketing. Some 66 per cent of respondents expect to see a growth in interactive, compared to 45 per cent for database marketing and 34 per cent for direct marketing.
Respondents say open media, online advertising, mobile marketing and search marketing will propel the growth in the sector, with 49 per cent looking to secure additional skills or services as the lead motive for M&A activity. Open media, which includes blogging and podcasting, is expected to be the fastest growing field of Internet marketing, according to 34 per cent of the respondents.
Mandy Merron, partner at WKS, says: "A number of established businesses are working hard to develop digital expertise and this survey suggests they are right to do so, although there is still a strong market for growing profitable businesses with strong management from any discipline."
Overall, increased activity is expected in the M&A market in 2007, with buyers expecting to be more active than sellers. Levels of enthusiasm for takeovers are rising, with 59 per cent of sellers and 83 per cent of buyers believing they should act now.
Keith Hunt, managing partner at Results International, says: "It is apparent from the survey that M&A activity in the marketing communications industry will remain strong through 2007. Web/interactive remains the sector to look out for, with agencies across the industry expecting stellar performance in both growth and acquisition activity."

EMPTY BLEACHERS, UNHAPPY ATHLETES AT UALBANY.(CAPITAL REGION)

Alex Argulewicz has played football with the University at Albany Great Danes for four years. But his most memorable game didn't happen on his home home turf, nor in victory. It was a game more than 2,000 miles away, when his team was crushed, 45-7, by the University of Montana on Sept. 7.
It wasn't the score that so impressed the Walkill native, a sociology major who plays offensive guard. It was the crowd -- 19,000 football fans crammed into a stadium and cheering with abandon.
``You feel like people are there to see you play,'' he said. ``That's what playing football is all about.''
At UAlbany, where 470 student-athletes take part in 19 different varsity sports, too many bleachers are empty. And it's most noticeable in football, the highest-profile sport in higher education.
``Football on a Saturday afternoon is just fantastic to me. But it isn't for students,'' President Karen Hitchcock said at a recent public meeting. ``We have to get the word out.''
An average football game at UAlbany this season has attracted about 1,900 people -- and that includes attendance during homecoming weekend. Get a bad weather day, such as on Oct. 26, and the bleachers are virtually empty: just 634 people, with only a few dozen students, showed up to watch the Great Danes play St. Francis University on that drizzly day.
In 1998, UAlbany elevated its sports programs from Division II to Division I of the National Collegiate Athletic Association (the football team is 1-AA, one notch below the premier college teams, because UAlbany doesn't give football scholarships).
The idea was to raise the profile of the school's athletics at the same time the university is growing more prominent academically.
``We compete with Division I schools for faculty. We compete with Division I schools for students,'' Hitchcock said. So it made sense to compete with the best sports teams as well.
A number of schools have done the same thing -- at SUNY, Stony Brook, Binghamton and Buffalo are recent Division I members.
``If we want to be considered in the same sentence with Berkeley or Michigan, you've got to play with those boys,'' said Richard Laskowski, dean of physical education and athletics at the University of Stony Brook. ``It really does legitimize your entire university.''
UAlbany's decision to move to Division I was made by Hitchcock's predecessor, H. Patrick Swygert in the mid 1990s. A straw poll taken at the time to gauge student interest in Division status resulted in 1,437 votes in favor and 156 opposed. But the amount of students who didn't bother voting -- 14,407 -- also shows the apathy UAlbany is fighting.
``It's something you have to work with every day,'' said Lee McElroy, director of athletics and recreation at UAlbany for the last two years, who has made increasing student turnout at sports events one of his goals.
But at a time when students can get lightning-fast access to the Internet, two ESPN channels and the MSG network on cable TV, and enough high-quality video games to conduct a virtual Olympics in a dorm room, there's a lot of competition against a good, old-fashioned gridiron match. And that doesn't even take into account the part-time jobs, late-night partying and -- when there's time -- studying.
McElroy said student participation has increased since UAlbany joined Division I, though only marginally. Four years ago, about 5 percent of the 16,700-student body came to sports events. Today, attendance ranges from 10 to 15 percent, or from 1,670 to 2,500 students, he said.
Like many universities, UAlbany has tried all sorts of techniques to recruit students: T-shirt and visor giveaways, free pizza, even lotteries for ticket-holders for a free semester's tuition or first choice at next year's dormitory room.
Still athletes and spectators alike bemoan the empty benches.
``I know a girl who cheers for Syracuse University, and they get so excited going to games,'' said Leanne Jwaskiewicz, co-captain of the UAlbany cheerleading team. ``I forgot what that felt like.''
Among the 125 Division I schools in the NCAA, UAlbany ranks 109th in football attendance. And that's despite free admission for students. Meanwhile, the basketball team attracts an average of 1,649 people to games -- not too shabby, but a far cry from such prominent public universities as Connecticut, Michigan or Minnesota, which draw up to 200,000 spectators in a season.
Meanwhile, sports like soccer or lacrosse often attract from a handful to a few dozen students, even on sunny fall afternoons.
``It makes the game seem like it goes a lot longer if there's no one there,'' said Elizabeth Michalenko, a junior who plays defensive midfield in lacrosse.
The athletic department has asked student-athletes to support each others' sports. It's also started an advertising campaign, with a giant, eye-catching sports bulletin board in the Campus Center. More are planned for dorms. Posters announcing games are put up all over campus.
Do students notice? Some think not.
``An 8-by-11 piece of paper stapled to a pillar is no longer effective,'' said Joey Favata, vice president of the student government's Central Council ``I think people need to create new ideas.''
Some say the best way to attract student fans has nothing to do with posters or free tuition.
``If you want students in the seats, you've got to win,'' Stony Brook's Dean Laskowski said. ``And if you're going to lose you'd better be exciting when you lose.''
The UAlbany football team has six wins and four losses and leads the seven-team Northeast Conference.
But winning isn't everything. History helps. Siena, with a 60-year basketball legacy, lures up to 1,500 students at its men's basketball games at the Pepsi Arena. Rensselaer Polytechnic Institute draws about the same number to its Engineers hockey games. (Siena's tickets are free to students, while RPI's tickets cost $4.)
Union, which gives free football tickets to students and faculty, has seen interest in games go up. In the past, about 100 students and faculty got tickets. But on Oct. 12, more than 800 showed up for the match against RPI. The school opened a $1.7 million stadium this fall.
At Stony Brook, which joined Division I the same year as UAlbany, Laskowski said a new $26 million stadium has helped bring an average of 6,500 people to games. That's despite the presence of other colleges, countless high schools and two professional football teams in the New York metropolitan area.
Stony Brook has used high-ticket gimmicks, too, such as a $100,000 kicking contest sponsored by Coca-Cola and Long Island supermarket chain King Kullen.
UAlbany does hope to some day build a new football stadium. The present field contains bleachers for 4,000, smaller than some high school stadiums.
McElroy, UAlbany's athletic director, said as the school continues to play big teams, rivalries will build, attention to the games will increase and the school will attract more publicity, luring in more students and community members.
``Notre Dame has been at it for a long time. They've got a bigger fan base. They've been doing it for 100 years,'' he said. ``You have to start with a foundation.''
